We are MyGx Pty Ltd, operators of MyGuarantee. MyGx Pty Ltd is a wholly owned subsidiary of iDeed Pty Ltd, the operator of the ARCGx Application (“Application”), which holds records of bank guarantees. The Application is used to establish and create records, and communicate with other users, in relation to bank guarantees that issuers (including MyGuarantee), beneficiaries, and applicants have an interest in.

This policy explains how we manage personal information when you use the Application and within our organisation.

  1. Kinds of Personal Information We Collect

We may collect and hold the following personal information: • Identifying information (first and last name) • Contact information (email address, telephone number) • Usernames, passwords, and access codes created when registering • Images and video of you and your identity documents (for AML/CTF/Fraud purposes) • Technical information regarding your device (to assist with fraud prevention) • Records of our communications with you

Without this information, we may not be able to provide access to the Application or respond to your requests.

  1. Electronic Verification of Identity

We and bank guarantee issuers have obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act (AML/CTF Act).

You consent to us disclosing your name, address, and/or date of birth to a credit reporting body (CRB) for identity verification purposes. The CRB may compare your details with their records and provide an assessment to us. We may also use the Commonwealth Attorney General’s Department Document Verification Service (DVS). For more details, visit www.dvs.gov.au.

You also consent to providing biometric information (such as a selfie) for identity verification. We may share verification results with the bank guarantee issuer.

If you do not consent, we may use other reasonable means to verify your identity.

We collect personal information: • Directly from you (e.g., when logging into the Application or submitting a request) • From your employer or an authorised person • From third parties • From publicly available sources

  1. Purposes for Which We Use Personal Information

We use your personal information to: • Operate and maintain the Application • Facilitate your use of the Application • Assist with the issuance, payout, and cancellation of bank guarantees • Improve the Application and our services • Comply with legal and regulatory obligations • Compile statistics and reports • Manage and resolve complaints or issues

We may also use your information for purposes authorised by you or required by law.

  1. People to Whom We Disclose Personal Information

We may share your personal information with: • Other users of the Application (as required to facilitate services) • Your employer or authorised representatives • Your advisers or other authorised parties • Our staff and business partners (including technology providers) • Professional advisers (e.g., auditors) • Government authorities (where required by law)

We will not disclose your personal information outside Australia.

We take reasonable steps to ensure that your information is accurate, complete, and up-to-date. We store personal information in electronic databases (some managed by third-party providers) and use physical and technical safeguards to protect it.

We retain personal information for as long as necessary for its purpose or as required by law.
